The Elections and Ethics Enforcement Act mandates that the Chair inquire as to whether any member knows of any known conflict of interest or appearance of conflict with respect to matters before the Commission. Executive Order 34 requires any member to recuse herself or himself from voting on any matter before this Commission which would confer a financial benefit on the member. If any member knows of a conflict of interest, appearance of a conflict, or possible financial benefit please so state at this time. Chairperson Morehead

B. Review of Commission Internal Operating Procedures Mr. Phillip Reynolds, Counsel
Counsel will review the “Internal Operating Procedures of the Mining Commission of North Carolina” with the Commission, followed by discussion and action by the Commission.
C. Rule 5C Joint Letter Review Mr. Phillip Reynolds, Counsel
Update from counsel on the proposed joint letter with Oil and Gas Commission to be sent to the Rules Review Commission requesting responsibility for Subchapter 5C – Geophysical Exploration rules be transferred to the Oil and Gas Commission. Both Commissions will need to be in agreement on the letter.
D. Committee on Rules Readoption Report Mr. Samuel Bratton, Committee Chair
Report from the Rules Committee regarding the proposed technical changes to existing rules.
III. New Business
A. Rules Readoption Process Update – Phase II Mr. Douglas Ansel, Acting Director
The Division will provide an informational update regarding the ongoing process for Rules Readoption, specifically what is to be addressed in the second phase of the two-phase approach being pursued by the Commission. This will include an update regarding the Stakeholder Group that will be utilized by the Division to prepare the first draft of the new or substantively changed rules for the Rules Committee to use as a starting point.
B. Presentation by Albemarle Lithium Mr. Alexander Thompson, Vice President Ms. Kirsten Martin, Community Manager
Albemarle has requested the opportunity to present to the Mining Commission regarding advancing responsible mining and building resilient communities to support US critical mineral independence.
